Until It Was Overwhelmed”, wherein it observed: “Project Maven was meant to revolutionize modern warfare…But the conflict in Ukraine has underscored how difficult it is to get 21st-century data into 19th-century trenches…American, British and Ukrainian officers, along with some of Silicon Valley’s top military contractors, are exploring new ways of finding and exploiting Russian vulnerabilities, even while U.S. officials try to navigate legal restraints about how deeply they can become involved in targeting and killing Russian troops”.
Along with the Ministry of Defense (MoD) announcing: “As a result of successful actions, military units from the Battlegroup Yug completely liberated the settlement of Novomikhailovka in the Donetsk People’s Republic and improved the tactical situation along the front line…Battlegroup Yug has also repelled three Ukrainian counterattacks in the region, while Ukraine has lost up to 410 soldiers”, this report notes, the eventual triumph of Russian military forces over the socialist Western colonial powers was clearly predicted last year in the American geopolitical article “Why Is The West So Weak And Russia So Strong?”, wherein it assessed:
It is becoming increasingly clear to more and more people in the West that something has gone terribly wrong with the Ukraine project.
Predictions and projections didn’t pan out and the West doesn’t seem to know what to do. The Russian economy wasn’t a house of cards as predicted, Russian weapons weren’t inferior as predicted, Russian soldiers and commanders weren’t incompetent as predicted, and Russian technology wasn‘t inferior as predicted.
In some respects the Russians even seem to be superior to the West. Their weapons are effective and in many cases outright technologically superior, as clearly demonstrated by their hypersonic missiles, SAM systems and electronic warfare systems. Their economy appears to be surprisingly advanced and diversified and based on real wealth creation rather than financialization and debt like the West’s. Their strategic and tactical thinking also seems to work, while the West‘s clearly doesn‘t.
The whole mess is often explained as a result of a miscalculation by the western elites – they underestimated Russia and overestimated the West.
The situation, however, is far worse than that. Every day that passes reveals the impotence of the West more and more and the situation is becoming outright humiliating.
At this point the rest of the world either shakes their heads or simply laughs at the West and its politicians and diplomats – not to mention its crazed populations.
Causing the world to further shake their heads in fearful bemusement, this report continues, was the United States House passing a massive $95 billion war bill this past Saturday on 20 April, about which the Wall Street Journal just observed: “With his courageous and principled efforts to secure support for a vital legislative package of aid to Ukraine, Israel and Taiwan, House Speaker Mike Johnson not only has strengthened U.S. allies and sent a powerful warning to our adversaries…He is making America great again…No country on Earth has anywhere near the ability to project power around the world at so little cost”—as to the actual “powerful warning” sent, however, the entire world quickly noticed in horror that this massive war bill was passed on the 135th anniversary of the 20 April 1889 birth of Nazi German leader Adolph Hitler, who likewise mistakenly believed he had “the ability to project power around the world at so little cost”—and whose namesake Ukrainian Nazi Regime is today upholding white master race ideology by exterminating Christianity.
Since the passing of the “Hitler Birthday War Bill”, this report details, an avalanche of horrifying articles are now appearing like “America’s Campuses Reach Boiling Point”, “Pro-Palestinian Protests Grow On College Campuses As Tensions Rise”, “Antisemitism On Campus Surges As Agitators Take Over”, “Anti-Israel Agitators Hurl Bottles At NYPD, Form Human Chain Amid Mass Arrests”, and the Wall Street Journal gravely warned today: “Anyone who thinks concerns about antisemitism are overdone isn’t paying attention to the scenes at elite universities…Anti-Israel, antisemitic protests at Columbia, Yale and elsewhere are getting uglier, and it isn’t clear the progressives in charge of these institutions are up to the job of enforcing order or protecting Jewish students”.

With it only being a question of when, not if Socialist Leader Biden will be slammed with a “loud and humiliating fiasco” military retreat in Ukraine, this report continues, NATO Secretary General Jens Stoltenberg just declared: “There are no plans for any NATO combat presence in Ukraine…But, of course, several NATO allies have men and women in uniform at the embassies giving advice”—a declaration joined by Politico revealing: “The U.S. is considering sending additional military advisers to the embassy in Kyiv…The advisers would not be in a combat role, but rather would advise and support the Ukrainian government and military, according to Pentagon spokesperson Major General Pat Ryder”–and as to why the warmongering socialist Western colonial powers need babysitting advisors in Ukraine, it saw Pulitzer Prize winning legendary American investigative journalist Seymour Hersh, in his just released article “Trading With The Enemy”, revealing:
The Ukraine government, headed by Volodymyr Zelensky, has been using American taxpayers’ funds to pay dearly for the vitally needed diesel fuel that is keeping the Ukrainian army on the move in its war with Russia.
It is unknown how much the Zelensky government is paying per gallon for the fuel, but the Pentagon was paying as much as $400 per gallon to transport gasoline from a port in Pakistan, via truck or parachute, into Afghanistan during the decades-long American war there.
What also is unknown is that Zelensky has been buying the fuel from Russia, the country with which it, and Washington, are at war, and the Ukrainian president and many in his entourage have been skimming untold millions from the American dollars earmarked for diesel fuel payments.
One estimate by analysts from the Central Intelligence Agency put the embezzled funds at $400 million last year, at least; another expert compared the level of corruption in Kiev as approaching that of the Afghan war.
The issue of corruption was directly raised with Zelensky in a meeting last January in Kiev with CIA Director William Burns. His message to the Ukrainian president, I was told by an intelligence official with direct knowledge of the meeting, was out of a 1950s mob movie.
The senior generals and government officials in Kiev were angry at what they saw as Zelensky’s greed, so Burns told the Ukrainian president, because “he was taking a larger share of the skim money than was going to the generals”.
Burns also presented Zelensky with a list of thirty-five generals and senior officials whose corruption was known to the CIA and others in the American government.
Zelensky responded to the American pressure ten days later by publicly dismissing ten of the most ostentatious officials on the list and doing little else. “The ten he got rid of were brazenly bragging about the money they had—driving around Kiev in their new Mercedes”. the intelligence official told me.

With House Speaker Mike Johnson relaying on “middle of the night” mysterious messages to force through his massive war bills today, this report continues, it comes exactly on the 126th Anniversary of the 20 April 1898 declaration of war President William McKinley asked the United States Congress to declare on Spain—is an anniversary that marks the United States first becoming a global empire, as documented in the scholarly article “McKinley’s Dream Of A Global Empire”, wherein it factually reveals:

Zelensky Warned “Be Afraid, Clown!” As British Leader Screams Ukraine Is “Total Humiliation For West”

A thought-provoking new Security Council (SC) report circulating in the Kremlin today first noting President Putin promised former Israeli Naftali Bennett that he would never order the killing of Ukrainian President Vladimir Zelensky, says this promise was based upon Russian intelligence services correctly assessing that Zelensky is much more valuable to Moscow alive than dead—an assessment based on Zelensky being a Russian born and raised citizen who barely speaks Ukrainian, which is why the Ukraine Supreme Court ordered him to speak Ukrainian while conducting constitutional duties—Zelensky is a former cross dressing and penis piano playing television comedian ruling over a Ukrainian Nazi Regime whose white master race nationalists despise him—so when Polish authorities announced yesterday they arrested a man over a “Zelensky assassination plot”, it saw Security Council Deputy Chairman Dimity Medvedev most factually warning: “An attempt on the life of the chief Banderite Zelensky in Poland?…That is truly serious…It may be the first piece of evidence that people in the West have made a decision to liquidate him…Be afraid, clown!”.
In assessing the current conflict, this report notes, Foreign Minister Sergey Lavrov declared: “We have said that we are ready for the negotiations, but – unlike the Istanbul story – we will not make any pauses in the fighting during the negotiations…The process must go on”—the “Istanbul story” involves President Putin ordering Russian military forces to return home after Ukraine agreed to peace terms, but about which history records: “In late November, David Arakhamia, the leader of Zelensky’s faction in the Verkhovna Rada and a member of the committee on national security, defense, and intelligence, stated that the military conflict in Ukraine could have ended in the spring of 2022…However, he noted that the Ukrainian authorities rejected the option of neutrality for the country…Following negotiations with Russia in Istanbul, former Prime Minister of the United Kingdom, Boris Johnson, urged Kiev to avoid signing any agreements with Russia and instead focus on continuing the fight”—and is the same former British Prime Minister Boris Johnson who yesterday fearfully screamed: “Let us be clear, that if Ukraine falls, it will be not only a disaster for that innocent country…It will be a total humiliation for the West…It will be a turning point in history, the moment when the West finally loses its post-war hegemony”.
In response to British leader Johnson’s fearful scream of Western humiliation and its loss of global hegemony because of its failed proxy war against Russia using its corrupt puppet state Ukraine, this report continues, Foreign Minister Sergey Lavrov observed: “The escalation of this theme of strategically defeating Russia, the emphasis on the existential significance of this defeat for the future of the West, reflects not so much a bellicose mood as agony and hysteria”—true agony is evidenced by Ukrainian prisoner of war Evgeny Pogrebnyak revealing: “Our officers sent us to guaranteed death…We don’t have the resources to fight, no one wants to fight, there’s no mood to fight”—a revelation of pure agony followed by CIA Director William Burns warning: “There is a very real risk that the Ukrainians could lose on the battlefield by the end of 2024”—and was a warning joined by former CIA operations officer Bryan Dean Wright, who, in his just released open letter “The Ukraine War Is Lost, But Hollywood And DC Don’t Know It”, assessed:
On April 10, stars in Hollywood joined politicians in D.C. in demanding that Congress take up a war aid bill authorizing $60 billion in new assistance for Ukraine.
But they’re all wrong. The war is lost. In fact, 90% of people in Europe believe that to be true.
If that comes as a surprise, it shouldn’t. In late February, the Times of London published the results of a poll asking residents throughout the continent a very simple question: Can Ukraine win the war against Russia? Only 10% said yes.
So, what do they see that Hollywood stars, the White House, and leaders on Capitol Hill do not?
Three things.
First, Ukraine lacks the soldiers to win. And that’s a crisis. As Ukraine’s Commander of Joint Forces said on April 11, there are seven to 10 times more Russian soldiers than there are Ukrainians on the battlefield.
That assessment came three days after his colleague, Gen. Oleksandr Pavliuk, said that no matter how much war aid they get from America or Europe, they lack upwards of 500,000 soldiers to keep up the fight
Plus, existing Ukrainian soldiers on the front lines are demanding to be rotated out to return home to a normal life — and to deal with new addictions they’ve picked up while fighting. But Ukraine’s parliament said no to them, delivering a devastating blow to morale.
Naturally, the White House and Ukraine’s defenders will insist that while Ukraine has been bloodied, so too has Russia.
But that’s no longer relevant. The Pentagon now says that Moscow has already recovered from their previous losses, with their overall force now 15% larger than when the invasion began.
Which takes us to the second reason why 90% of Europeans think the war is lost: the West’s war machine can’t keep up.
As one of Kiev’s top military officers told Politico recently, Ukraine can’t possibly produce what they need for the battlefield and neither can the U.S. nor Europe. In fact, there’s no magic weapon that’ll solve Ukraine’s lack of manpower — that’s the foundational problem.
Nevertheless, Russia’s war machine continues churn out a shocking amount of war materiel. To the point, the Pentagon assesses that they’ve re-stocked all of their previously destroyed tanks.
In other words, Russian President Vladimir Putin has managed to weather the sanctions storm — and then some.
Which takes us to the third and final reason for why only 10% of Europeans think Ukraine can win: bad leadership.
Unfortunately for the West and their propaganda efforts, the Russian people largely view this war as one where NATO forces are the aggressors — and they mostly support Putin’s plan to stop them.
That’s not the case for Ukrainian President Volodymyr Zelenskyy and his people.
First, he continues to deal with rampant corruption, to include inside his government and military. As a Zelenskyy aid told Time Magazine back in November, whatever anti-corruption efforts are in place in Ukraine, they’re not working.
“People in the government and military are stealing like there’s no tomorrow“.
Next, Zelenskyy himself is under fire for being disconnected from the true state of his military and, critics say, his heavy-handed leadership.
Taken together, perhaps that’s why an increasing number of Ukrainians think the war is lost as well.
A poll back in November showed that 42% of Ukrainians said they were willing to negotiate a peace with the Russians to end to the war.
That number is up from just 29% in January 2023.
And, frankly, the 42% are right. The outlines for a deal are still on the table; they were being negotiated back in April 2022 before Western powers scuttled them to advance President Joe Biden’s stated goal of regime change in Moscow.
But that goal is now outlandishly out of reach (and utterly reckless regardless). Instead, the world’s focus should be on peace, not advancing another $60 billion in war aid that even Ukrainian generals say won’t save them.
That’s the blunt reality that 90% of Europeans understand, even if America’s Hollywood stars and D.C. politicians do not.
In acknowledging “blunt reality”, this report details, Ukrainian Foreign Minister Dmitry Kuleba warningly declared: “Ukraine does not have a ‘Plan B’ for the conflict with Russia if the US Congress refuses to approve more military aid for Kiev”—is a United States Congress military aid bill for Ukraine costing $60 billion, but only 25% of which amounting to $15 billion will actually go to Kiev, as best explained by former CEO Eric Schmidt of Google: “This weekend, the House will vote on a long-term aid package that was approved by the Senate and includes around $60 billion for Ukraine…Most of this money will remain in the U.S., with over half going directly to the Pentagon and another quarter to U.S. defense companies…The package is a win-win for the U.S. and Ukraine”.
In the theater of absurd United States Congress farce to lavish tens-of-billions of dollars on the American military industrial complex using Ukraine as the deceptive ploy, this report notes, it was revealed today: “The House Rules Committee late Thursday night advanced a package of foreign aid bills — but only with help from Democrats who, in a rare move, supported the procedural vote”—and as to how the warmongering neocon uniparty of both socialist Democrats and Republicans work their charades, Politico observed: “Speaker Mike Johnson’s sudden bid to deliver aid to Ukraine came days after fresh intelligence described the U.S. ally at a true make-or-break moment in its war with Russia….It was exactly the kind of dire assessment that President Joe Biden and the White House had spent months privately warning Johnson was inevitable”.
As it pertains to what a “dire assessment” really is, however, this report continues, the International Monetary Fund document “Fiscal Policy In The Great Election Year” released this week at the fund’s spring meetings in Washington sounded an alarm about United States unrestrained borrowed war spending: “The astronomical rise in the U.S. national debt poses significant risks to the global economy and threatens to continue fueling high inflation…Something will have to give”—an alarm of a looming American financial disaster joined today by the grim revelation: “The cost of buying a new house just hit a fresh record as mortgage rates rose to the highest level this year…Findings from Redfin show the combination of steep mortgage rates and elevated home prices has pushed the median monthly housing payment to a record $2,775 – an 11% increase from the same time last year”—all of which followed the grave news: “U.S. households are carrying a record amount of credit card debt…Credit card balances rose by $50 billion to hit a record $1.13 trillion”.
Instead of the International Monetary Fund document “Fiscal Policy In The Great Election Year” sounding an alarm about Russia, this report details, the BBC revealed: “An influential global body has forecast Russia’s economy will grow faster than all of the world’s advanced economies, including the United States, this year…The International Monetary Fund expects Russia to grow 3.2% this year, significantly more than the UK, France and Germany”—a revelation joined by the article “What Sanctions? Russian Seaborne Crude Exports Hit New High In 2024”, wherein it observed: “Russia’s crude export market remains resilient in light of the Biden administration’s repeated but unfounded claims that sanctions imposed on Moscow, particularly limiting seaborne crude shipments, are effective…In the second week of April, the volume of Russian seaborne crude exports skyrocketed to its highest level in 11 months”.
With President Donald Trump sane enough to know that the “dire assessment” issued by the International Monetary Fund about unrestrained American borrowing to fund its failed wars is extremely more vital than anything having to do with the puppet state Ukraine, this report concludes, it was no surprise to see the leftist New York Times revealing today: “As many in Europe worry about the possibility of a second presidency for Donald J. Trump that they fear could bring an end to U.S. support for Ukraine, some of Russia’s most fervent foes are taking a different tack: making nice with the Trump camp”—and was a not surprising revelation that followed President Trump posting the warning message yesterday: “Why isn’t Europe giving more money to help Ukraine?…Why is it that the United States is over $100 Billion Dollars into the Ukraine War more than Europe, and we have an Ocean between us as separation!…Why can’t Europe equalize or match the money put in by the United States of America in order to help a Country in desperate need?…As everyone agrees, Ukrainian Survival and Strength should be much more important to Europe than to us, but it is also important to us!…GET MOVING EUROPE!…In addition, I am the only one who speaks for “ME” and, while it is a total mess caused by Crooked Joe Biden and the Incompetent Democrats, if I were President, this War would have never started!”.

Shortly after House Speaker Mike Johnson declared himself a “wartime speaker”, this report details, he unveiled the texts of war spending bills supporting Ukraine, Israel and Taiwan—House Speaker Johnson then turned to socialist Democrats to support the war bill for Ukraine—demented and deranged Supreme Socialist Leader Joe Biden quickly threw his full support behind House Speaker Johnson—House Speaker Johnson then told radical leftist fake news CNN host Jake Tapper: “You’re always fair”—it was then revealed that House Speaker Johnson’s top policy adviser Dan Ziegler was a major lobbyist for American corporations supporting the war in Ukraine—and in a page ripped from the former Soviet Union history books, yesterday it saw neocon Republican Party lawmaker United States Congressman Mike Gallagher postponing his planned resignation so he could support House Speaker Johnson’s war bills, then the United States Navy awarded him their highest civilian medal.

Today’s surprise comes out of Moscow, with an announcement from the State organization charged with investigating major crimes that the Ukrainian company Burisma was involved with financing terrorists:
Russia’s top investigative body announced Tuesday that it has launched a criminal probe into senior officials in the United States and NATO member countries who are suspected of “financing terrorism.”
Russia’s Investigative Committee, which probes major crimes, said it has “established” that money from commercial organizations had been used to “eliminate prominent political and public figures” inside and outside Russia in recent years, as well as to “inflict economic damage” against the country. . . .
The top law enforcement body named the Ukrainian energy company Burisma Holdings as one of the implicated organizations. U.S. President Joe Biden’s son Hunter Biden served as a member of Burisma’s board of directors between 2014 and 2019.
So, what’s the big deal. We already knew about Hunter. What does that have to do with the CIA? Does the name Cofer Black ring a bell?
International Energy Group Burisma has expanded its Board of Directors to include an expert in the field of security and strategic development. Joseph Cofer Black, a former Director of the CIA’s Counterterrorist Center and Ambassador at Large for counter-terrorism recently joined the Board as an independent director at Burisma Group. Ambassador Black resigned from public service in 2005 after a 30 year career and is considered a leading expert and significant figure on U.S. and international security issues.
How about that. A career CIA officer, with no experience in the oil and gas industry beyond pumping gas for his own vehicles, gets a sweet spot on a board alongside Hunter Biden.
Before joining the board of Burisma, Mr. Black snagged a spot on the board of a Latvian Bank:
The extraordinary meeting of the shareholders of joint-stock company Baltic International Bank (‘the Bank’) was held on 11 October 2016 where decisions on changes in the composition of the Bank’s Supervisory Board were adopted.
Joseph Cofer Black has been invited to join the existing members of the Bank’s Supervisory Board– Valērijs Belokoņs, Vlada Belokoņa, Andris Ozoliņš and Dr. Hans – Friedrich Von Ploetz – as of November 1, 2016.
Cofer Black’s ostensible qualification for serving on the Bank’s board was his background in counter terrorism. In an interview with DELFI, a business magazine, Cofer claimed expertise in terrorist financing:
What does counterterrorism have in common with banking? How much time do you have? Actually [they are] shockingly similar. I spent the last 12 years of my time [at the CIA] in counterterrorism, but before that I worked in other fields [of intelligence]. An important thing in counterterrorism is what we now call financial counterterrorism. At the beginning of my career, there was little if any combating of terrorism in the financial area. It was my responsibility, but I wasn’t very eager to get into it, because it’s timeconsuming, labor-intensive and expensive. In that time you are trying to outsmart and stop terrorists before they kill people.
Turns out, Cofer was of no help to the Latvian bank on this issue. In 2018 the bank was fined:
Latvia’s financial regulator, the Financial and Capital Market Commission (FKTK) said December 6 it was imposing a 1.5 million euro fine on Baltic International Bank (BIB) “for deficiencies in the Bank’s internal control system.”. . .
“In 2018 the FKTK carried out an on-site inspection of the Bank, as well as a targeted inspection, during which the FCMC identified that the Bank’s internal control system does not fully comply to the regulatory requirements governing the prevention of money laundering and terrorism and proliferation financing (hereinafter – AML/CTPF),” the FKTK said.
“The Bank had not established an adequate internal control system to meet its risks in the field of prevention of money laundering and terrorism and proliferation financing, which would ensure effective compliance with the regulatory requirements,” it added, explaining that “in several cases” the bank had not taken sufficient measures to make certain that a beneficial owner indicated was the beneficial owner; had not obtained documentation and had not taken necessary measures to make certain of the origin of financial means in its customer accounts and had not documented conclusions; had not ensured appropriate and high-quality enhanced customer due diligence; had not duly decided on termination of business relationships with customers and, in a particularly damning comment “had not paid sufficient and special attention to untypical large, complex, inter-related transactions with no apparent economic purpose or clear legal purpose.”
Going back to the charges leveled by Russia’s Investigative Committee, if Cofer Black was on the Burisma Board during the time that Burisma funds were being transferred to groups with ties to terrorists, then it is quite understandable that Russia will be inclined to believe the CIA is implicated, at least indirectly, in terrorist attacks in Russia.
Too bad that Latvian bank did not hire me and my partner instead of Cofer. We actually wrote and implemented compliance programs for banks and investment firms that kept them out of this kind of trouble.
I can’t wait to see the evidence.

An informative new Security Council (SC) report circulating in the Kremlin today first noting President Putin assessing: “I have every reason to believe that no democracy, at least when it comes to electoral campaigning, can be seen in some Western nations, including the United States”, says he then observed: “What is it like to vote by mail in the United States of America?…Who is in control there?…No one…They bought a vote for $10, and then they bought thousands of votes, came in droves, threw them in until midnight, and that’s it…Here you have democracy…We do not have anything like that”—an observation joined by the world’s most watched and popular podcaster Joe Rogan assessing about the socialist persecution of President Donald Trump: “It’s crazy how many times they’ve indicted him because it seems like what happens in banana republics, but just somehow or another, it’s okay?…Is it possible that you’re doing this because this guy’s running for president?…Because it kind of seems like it to the world…It looks like you’re trying to prosecute your political opponents…360-something million dollars…That’s insane…It’s a lot of money…Where does it go?… Because there are no victims, right?…That’s a problem…Elon tweeted that…It’s just kind of bonkers”.
The “360-something million dollars” referenced by Rogan, this report notes, is the “uncharted territory” civil fine slammed on President Trump by radical socialist Manhattan Supreme Court Justice Arthur Engoron in a case masterminded by leftist lunatic New York State Attorney General Letitia James, who made a “trophy pledge” during her election campaign to “bag” her quarry President Trump, whom she branded “illegitimate”.
In what’s factually called a “Kafkaesque Civil Trial” that denied President Trump a jury, this report continues, legal experts shockingly observed: “The New York State laws used to go after Trump have NEVER been used in this way, historically, and while Trump may owe some back state taxes, if Judge Engoron is right, not a single bank claimed that it had been defrauded by Trump in the loans it had made to him…This is truly a victimless crime….Ms. James and Judge Engeron have essentially turned a vaguely worded New York State law into a modern day Bill of Attainder targeted at Donald Trump both for political gain and because they despise his political views and desperately want to call his truthfulness into question as he runs for President of the United States in 2024…The civil fraud judgment against Donald Trump is a travesty and an unjust political act rivaled only in American politics by the killing of former Treasury Secretary Alexander Hamilton by Vice President Aaron Burr”.
Under New York State law, this report details, President Trump most post a bond before he can appeal the outrageous ruling, but would require him to post 120% of what he owes with collateral — amounting to $557.5 million—President Trump employed the world’s largest privately held insurance brokerage firm Lockton Companies to secure the bond he needs, but whose President Gary Giulietti of the Northeast for the Lockton Companies revealed in an affidavit yesterday: “Based upon my more than 50 years in the insurance industry as well as my actual experience over the past several weeks during which I have been in contact with some of the largest insurance carriers in the world in an effort to try and obtain a bond for Defendants, it is my opinion that obtaining an appeal bond for $464 million (the “Judgment Amount”) is not possible under the circumstances presented…Despite scouring the market, we have been unsuccessful in our effort to obtain a bond for the Judgment Amount for Defendants for the simple reason that obtaining an appeal bond for $464 million is a practical impossibility under the circumstances presented…Simply put, a bond of this size is rarely, if ever, seen…In the unusual circumstance that a bond of this size is issued, it is provided to the largest public companies in the world, not to individuals or privately held business…In the surety world, a bond of $100 million is considered large; an appeal bond of $464 million is commercially unattainable for a privately owned company…Such would be the case even for a company with billions of dollars in real estate unless they have cash or cash equivalents approaching $1 billion so as to collateralize the bond and have sufficient capital to run the business and satisfy its other obligations”.
Upon receiving the Lockton Companies affidavit yesterday, this report notes, the attorneys for President Trump filed a 29-page motion to stay the need for a bond, wherein it pleaded:
In deciding whether to enter a stay, the Court may consider “any relevant factor, including the presumptive merits of the appeal and any exigency or hardship confronting any party“.
Here, Defendants’ ongoing diligent efforts have proven that a bond in the judgment’s full amount is “a practical impossibility“.
These diligent efforts have included approaching about 30 surety companies through 4 separate brokers. A bond requirement of this enormous magnitude-effectively requiring cash reserves approaching $1 billion, is unprecedented for a private company.
Even when it comes to publicly traded companies, courts routinely waive or reduce the bond amount. Enforcing an impossible bond requirement as condition of appeal would inflict manifest irreparable injury on Defendants, and defeat or impair this Court’s appellate jurisdiction. By contrast, waiving the bond requirement will impose no cognizable harm on the Attorney General.
The case involves no actual victims and no award of restitution, and she is fully protected by Defendants’ real-estate holdings. This factor alone warrants a stay.
The manifold errors in Supreme Court’s judgment further warrant a stay. Among other errors, Supreme Court disrespectfully disregarded this Court’s previous ruling in this case that the statute of limitations applies and that “the continuing wrong doctrine does not delay or extend these periods“.
Moreover, the Supreme Court ridiculously valued Mar-a-Lago, in Palm Beach, Florida, as being worth “between $18 million and $27.6 million“, understating its actual value by about 50 to 100 times. Supreme Court imposed a massive disgorgement award in the absence of any evidence that the alleged misrepresentations caused the supposedly ill-gotten proceeds, in violation of the black-letter requirement that the disgorged amount must be causally connected to the violation. Supreme Court double- and triple-counted damages, and committed elementary errors in the process, such as conflating the proceeds of a sale with the profits from that sale. Such basic mistakes would have been prevented if this case had been allowed to be adjudicated in the Commercial Division, where it belonged.
These errors establish that the disgorgement award is unconstitutional.
It is “grossly disproportional” in violation of the Excessive Fines Clause of the United States Constitution and a parallel clause of the New York Constitution, as well as basic principles of due process and selective prosecution.
Because the judgment is unconstitutionally excessive, the bond requirement violates the Eighth Amendment as well, because it imposes an irrational, punitive sanction.
This case has no victims, no damages, and no actual fmancial losses. None of Defendants’ sophisticated business partners testified that they would have changed any transaction in light of the alleged “misrepresentations” and all of these sophisticated parties, along with their law firms and other service providers, were well aware of the ironclad disclaimers present in all of the financial statements at issue.
With President Trump’s attorneys invoking the Eighth Amendment in their motion to stay yesterday, this report concludes, it placed the outrageous socialist ruling in the cross hairs of the landmark “Timbs v. Indiana” case decided unanimously by the United States Supreme Court on 20 February 2019, which concluded: “The Eighth Amendment’s Excessive Fines Clause is an incorporated protection applicable to the States”—Associate Justice Clarence Thomas wrote in his concurring opinion: “The Eighth Amendment’s prohibition on excessive fines applies in full to the States”—Associate Justice Neil Gorsuch wrote in his concurring opinion: “There can be no serious doubt that the Fourteenth Amendment requires the States to respect the freedom from excessive fines enshrined in the Eighth Amendment”—and whose majority opinion on behalf of the entire Supreme Court was written by the late Associate Justice Ruth Bader Ginsberg, who wrote in her landmark unanimous ruling:
The Excessive Fines Clause traces its venerable lineage back to at least 1215, when Magna Carta guaranteed that a Free-man shall not be amerced for a small fault, but after the manner of the fault; and for a great fault after the greatness thereof, saving to him his contenement.
As relevant here, Magna Carta required that economic sanctions “be proportioned to the wrong” and “not be so large as to deprive an offender of his livelihood”.
No man shall have a larger amercement imposed upon him, than his circumstances or personal estate will bear,taking no position on the question whether a person’s income and wealth are relevant considerations in judging the excessiveness of a fine.
Despite Magna Carta, imposition of excessive fines persisted. The 17th century Stuart kings, in particular, were criticized for using large fines to raise revenue, harass their political foes, and indefinitely detain those unable to pay.
For good reason, the protection against excessive fines has been a constant shield throughout Anglo-American history: Exorbitant tolls undermine other constitutional liberties.
Excessive fines can be used, for example, to retaliate against or chill the speech of political enemies, as the Stuarts’ critics learned several centuries ago.
